Wrongful Death Lawsuit Filed Against Grubhub By Family of Judge Killed in Phoenix Car Crash

The Mroz family have initiated a lawsuit against Grubhub for the wrongful death of Superior

Court Judge Rosa Mroz, who was fatally hit by a car while crossing a Phoenix road in 2022.

Mroz was making her way across the intersection of 56th Street and Camelback Road on February 2, 2022 around 9:15 a.m. when a black Hyundai car hit her. At the time of the incident, the motorist stayed on the scene. Mroz was taken to a hospital in a very serious state and passed away on Feb. 5.

The lawsuit claims the motorist was distracted with their phone, allegedly attempting to finalize an order with Grubhub, when he hit Mroz. In the lawsuit, Grubhub is faulted for creating a business model that requires drivers to utilize their cell phones to complete orders, thus potentially creating dangerous scenarios on the roads.

Grubhub claims their delivery drivers agree to comply with all driving laws and regulations while working for Grubhub.

David Shapiro, whose law firm is representing the family of Mroz, expressed his concerns in regards to the issue of distracted driving. He emphasized that a few seconds of taking one’s attention away from driving can have a drastic effect on a life and the people close to them. The loss of Judge Mroz – wife, mother, daughter and an important public figure – has left a deep impact on all of her family and friends.

Mroz was the first Asian American woman to be appointed to a judgeship on the Maricopa County Superior Court.

The National Highway Traffic Safety Administration revealed that, between 2009 and 2016, pedestrian fatalities increased by 51 percent. Arizona was one of the states with the highest pedestrian death rate and pedestrian danger index, ranking seventh.
