Arizona Regulation Abolishes Parking Restrictions in Homeowner Associations

HOA Communities may see new change coming in their community.

If you live in a community governed by a Home Owner Association, you may have experienced the annoying warning letters of cars parked over overnight in front of your home. You may no longer need to worry about that any longer.

The concern lies in the fact that many of these HOA neighborhoods were not created with the expectation that there would be multiple cars and multiple people in the family who drive.

A new law which was implemented in April of this year in Arizona has stated that HOAs cannot control parking on public roads if their ordinances were established in 2015 or afterwards. For those HOAs that have parking regulations before December 31, 2014, they can make a decision as to whether they want to keep them or not.

The purpose of the new law is to update the outdated parking regulations as the urban area expands. The new law allows homeowners the authority to state that the parking regulations are not applicable in the present-day context. HOAs with the outdated regulations must make a formal decision concerning them before June 30, 2025.

The residents of their communities now have the power to abolish parking regulations if they so choose. This new legislation does not affect one-way roads, roads owned by a private entity, or condominiums.

Lawmakers encourage you to reach out to your HOA for clarification and possible future changes within your community.
